Divorce case: Wife’s WhatsApp chats can be valid evidence about her extramarital affair, even when obtained without her consent, rules Madhya Pradesh High Court

The High Court ruled that a husband can submit his wife's WhatsApp chats, obtained without her consent, as evidence in a divorce case to prove adultery. The court emphasized that the right to privacy is not absolute and can be superseded by the right to a fair trial. However whether to accept the wife's WhatsApp chats for extramarital affair charge or not is left upto the family court.
